Article 1 — Purpose
These terms and conditions (hereinafter "T&Cs") apply to all enrolments in DMOKA® training offered by DMOKA® International Academy (hereinafter "the Organisation"), delivered by Thierry Dudreuilh, lead trainer.
Any enrolment constitutes unreserved acceptance of these T&Cs.
Article 2 — Enrolment
Enrolment in DMOKA® training follows several steps:
2.1. The candidate fills in the enrolment request form on the website or contacts the trainer directly.
2.2. A preliminary interview (audio or video) is arranged with Thierry Dudreuilh. This exchange verifies the match between the candidate's profile and the training, and answers all questions. It is neither an exam nor a selective filter.
2.3. Following validation, an enrolment pack is sent to the candidate with payment details.
2.4. Enrolment is confirmed upon receipt of the deposit by the Organisation.
Article 3 — Fees and payment
3.1. Current fees are listed on the Sessions & enrolment page. They are expressed in Swiss francs (CHF) and vary by participant status.
3.2. A deposit is required to confirm enrolment. The deposit amount is specified in the enrolment pack sent after the preliminary interview.
3.3. The balance is due before the start of the first training module.
3.4. A 10% discount is granted for full early payment.
3.5. Optional module 4 may be offered free under certain conditions, detailed during the preliminary interview.
Article 4 — Cancellation and postponement
4.1. Cancellation by participant
All cancellations must be notified in writing (email with read receipt). The following conditions apply:
— Cancellation more than 30 days before the session start: full refund of deposit, less flat-rate administration fees.
— Cancellation between 30 and 15 days before: deposit retained but transferable to a later session.
— Cancellation less than 15 days before or no-show: deposit retained by the Organisation.
4.2. Postponement
Subject to availability, participants may request postponement to a later session. This request must be made in writing at least 15 days before the originally chosen session. One postponement per enrolment.
4.3. Cancellation by the Organisation
The Organisation reserves the right to cancel or postpone a session in cases of force majeure or insufficient participants. In such cases, sums paid are fully refunded or transferred to the next session, at the participant's choice.
Article 5 — Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, individual participants (excluding professionals acting in a professional capacity) have a 14-day period from enrolment confirmation to exercise their right of withdrawal, without penalty or reason.
This right is exercised by sending a clear email to the contact address on the website. If withdrawal is made within the deadline, sums paid are fully refunded within 14 days.
However, if training has begun before the withdrawal period expires with the participant's express agreement, the participant waives their right of withdrawal for modules already delivered.
Article 6 — Training delivery
6.1. Training is delivered in person, over 3 modules of 3 days each (72 hours total), with an optional module 4.
6.2. Venues, dates and times are communicated after enrolment confirmation.
6.3. Active participation and attendance at all modules are required for programme validation.
6.4. The Organisation reserves the right to refuse or interrupt participation if a trainee's behaviour disrupts the training, without entitlement to refund.
Article 7 — Intellectual property
All training materials (handouts, demonstrations, protocols, documents) are protected by intellectual property law. DMOKA® is a registered trademark.
Participants undertake not to reproduce, distribute or commercially exploit these materials without prior written authorisation from the Organisation.
Article 8 — Liability
DMOKA® training is a professional development programme. The Organisation cannot be held responsible for the use participants make of skills acquired after training.
Participants commit to practising within the scope of their professional qualifications and the supervision framework prescribed by the method.
Article 9 — Data protection
Personal data collected during enrolment is processed in accordance with the General Data Protection Regulation (GDPR). It is used exclusively for training administration and communication with participants.
Data is neither shared with third parties nor used for commercial purposes. Participants have the right to access, rectify and delete their data, exercisable by email to the contact address on the website.
Article 10 — Governing law and disputes
These T&Cs are governed by French law. In case of dispute, the parties undertake to seek an amicable solution before any legal action. Failing agreement, the dispute shall be submitted to the competent courts at the Organisation's registered office.
